In order to use the abppatropatri.com Site (hereinafter referred to as "Site"), you must register as a member of the Site (hereinafter referred to as "Member"). The Member or any users using the Site agree to be bound by these Terms of Use (hereinafter referred to as "Agreement"). 3. Term and Termination :

You may terminate your membership at any time, for any reason by writing to abppatropatri.com. In the event you terminate your membership, you will not be entitled to refund of any unutilized subscription fees. abppatropatri.com may terminate your access to the Site and/or your membership for any reason effective upon sending notice to you at the email address you provide in your application for membership or such other email address as you may later provide to abppatropatri.com or such other available modes as available. In the event of termination of membership you will not be entitled to any refund of any unused Subscription fees. Even after this Agreement is terminated, certain provisions will remain in effect including sections 4,5,7,9 -14, inclusive, of this Agreement. If at any time abppatropatri,com is of the opinion (in its sole discretion) or has any reason to believe that you are not eligible to become a member or that you have made any misrepresentation about your eligibility, abppatropatri.com reserves the right to forthwith terminate your membership and / or your right to use the Service without any refund to you of any of your unutilized subscription fee and to take action against you as permitted by the law of the land.

4. Non-Commercial Use by Members :

The Members or any users using the Site understands and accepts that abppatropatri.com Site is for the personal use of individual members only, and cannot be used in connection with any commercial endeavors under any circumstances including providing links to other web sites, whether deemed competitive to abppatropatri.com or otherwise. Organizations, companies and/or business houses cannot become Members of abppatropatri.com and should not use the abppatropatri.com Service or Site for any purpose whatsoever. Illegal and/or unauthorized uses of the Site, including unauthorized framing of or linking to the Site will be investigated, and appropriate legal action will be taken, including without limitation to civil, criminal and injunctive redress.

• Multiple profiles of the same person are not allowed on abppatropatri.com.abppatropatri.com reserves the right to deactivate all multiple profiles without any refund of subscription fees.
  
  
• You cannot engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service. You will not transmit any chain letters or junk email to other abppatropatri.com Members. Although abppatropatri.com cannot monitor the conduct of its Members off the abppatropatri.com Site, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent. In order to protect abppatropatri.com and/or our Members from any abuse / misuse, abppatropatri.com reserves the right to restrict the number of communications / profile contacts and responses / email which a Member may send to other Member in any 24-hour period to a number which abppatropatri.com deems appropriate in its sole discretion. * You cannot use any automated processes, including IRC Bots, EXE's, CGI or any other programs/scripts to view content on or communicate / contact /respond / interact with abppatropatri.com and/or its members.
  
  
• abppatropatri.com reserves the right to screen communications/messages that you may send to other Member(s) and also regulate the same by deleting unwarranted/obscene communications at any time at its sole discretion without prior notice to any Member.
  
  
• No Member is allowed to display his/her "Membership status" in the profile content. abppatropatri.com reserves the right to delete any such reference from the profile content.
  
  

6. Proprietary Rights in Content on abppatropatri.com:

abppatropatri.com owns and retains all proprietary rights in the abppatropatri.com Site and the abppatropatri.com Service. The Site contains the copyrighted material, trademarks, and other proprietary information of abppatropatri.com, and its licensors. Except for that information which is in the public domain or for which you have been given permission, you cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by abppatropatri.com without refund of any of your unused Subscription fees.

(III) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;

(B) THE LIMITATIONS ON ABPPATROPATRI.COM'S LIABILITY TO YOU IN PARAGRAPH ABOVE SHALL APPLY WHETHER OR NOT ABPPATROPATRI.COM HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

16. Arbitration / Dispute Resolution:

All disputes, differences and question of interpretation arising out of the provisions of this agreement and usage of this site by you shall be referred to a Sole Arbitrator to be appointed by ABP Private Limited solely. The provisions of the Arbitration and Conciliation Act, 1996 and rules made thereunder shall apply to such arbitration proceedings and the decisions of the said Arbitrator shall be final and binding upon both ABP Pvt. Ltd. and yourself.

17. Governing Law and Jurisdiction:

If there is any dispute about or involving the Site and/or the Service, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Kolkata , India only.

You agree to indemnify and hold abppatropatri.com, its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or any fraudulent act on your part.

19. Violation of Terms and Conditions:

If ABP Pvt. Ltd., in its sole discretion, determines that a violation of the Terms & Conditions has occurred, ABP Pvt. Ltd may pursue any of its legal remedies, including but not limited to the immediate deletion of any offending material from its site or/and cancellation of your account and/or the exclusion of any person(s) who may have violated any Terms & Conditions. ABP Pvt. Ltd could also pursue violators with claims that they have violated various criminal and/or civil law provisions as applicable under the relevant Acts/Rules, etc of the land. ABP Pvt. Ltd will cooperate with any investigation by any Central or/and State or/and local body or/and any court or/and tribunal having the competence to carry out the same. Such cooperation may be without notice to the User. If ABP Pvt. Ltd believes in its sole discretion that any advertisement or/and services may create liability for ABP Pvt. Ltd, ABP Pvt. Ltd may take any actions that it believes are prudent or necessary to minimize or/and eliminate its potential liability, including but not limited to, the release of User information. In sum, ABP Pvt. Ltd reserves the right to refuse service to anyone at any time, or/and to remove any listings or/and any advertisements for any reason, and without notice.

20. Changes to the Service; If We Cancel the Service:

ABP Pvt. Ltd. may change the service or delete features at any time and for any reason. ABP Pvt. Ltd. may cancel or suspend your service at any time and such cancellation or suspension may be without cause and/or without notice. Upon service cancellation, your right to use the service stops right away. Once the service is cancelled or suspended, any data you have stored on the service may not be retrieved later. Cancellation of the service by ABP Pvt. Ltd. will not alter your obligation to pay all charges made to your billing account.

21. Interpreting the Contract:

All parts of this contract apply to the maximum extent permitted by law: A court may hold that we cannot enforce a part of this contract as written. If this happens, then you and we will replace that part with terms that most closely match the intent of the part that we cannot enforce. The rest of this contract will not change. This is the entire contract between you and us regarding your use of the service. It supersedes any prior contract or statements regarding your use of the service. If you have confidentiality obligations related to the service, those obligations remain in force (for example, you may have been a beta tester). The section titles in the contract do not limit the other terms of this contract.

22. Assignment:

We may assign this contract, in whole or in part, at any time with or without notice to you. You may not assign this contract, or any part of it, to any other person. Any attempt by you to do so is void. You may not transfer to anyone else, either temporarily or permanently, any rights to use the service or any part of the service.

23. No Third Party Beneficiaries:

This contract is solely for your and our benefit. It is not for the benefit of any other person, except for permitted successors and assigns under this contract.

• By becoming a Member of the abppatropatri.com service, you agree to receive certain specific email from abppatropatri.com.
  
  
• You hereby confirm that as on date of registration, you have not registered yourselves on the Do Not Disturb (DND) subscriber list with any telecom operator / authority. In the event, you register yourselves as a Do Not Disturb (DND) subscriber, you hereby confirm that you do not have any objection to receiving messages (promotional or otherwise) from abppatropatri.com or any of its affiliate companies.
  
  
• This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the abppatropatri.com service, contains the entire agreement between you and abppatropatri.com regarding the use of the Site and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
  
  By becoming a member of abppatropatri.com and/or using the Services of the Site, you unconditionally and irrevocably confirm that you have read the above provisions and agree to abide by them.
